TFT was instructed by a claimant landlord who was looking to recover unpaid service charge contributions from one tenant: the tenant was withholding payment due to water ingress into their apartment. Our role was to give an opinion on the likely cause of the ingress and the likely cost of remedying the issue (if necessary) across the whole estate. We were engaged as an independent voice as the client previously relied on the opinion of a surveyor who had been engaged to remedy the problem and then suggested that the problem had been resolved.
Although we indicated that the problem was unfortunately ongoing, we were able to offer clear, independent advice which allowed the parties to resolve the potential litigation without further legal costs and in turn, to continue their relationship.
