We have undertaken a number of expert determinations and neutral evaluations where we have been appointed by both parties to determine the parties’ liabilities. The instructions involve reviewing the legal documents, inspecting the premises, receiving representations from the parties and publishing the binding determination (or non-binding neutral evaluation). The use of these forms of ADR allows the parties to resolve their disputes in a non-contentious, timely and economic manner.
Often, the parties had been to mediation and where just one aspect of the liability could not be agreed, it is referred to expert determination.
We have resolved disputes in England and Scotland and in sectors ranging from education, retail, office and industrial. We are frequently appointed by the President of RICS (or the Chairman of RICS Scotland) where the parties were unable to agree on the identity of a suitable expert.
